In Virginia, in most cases, the Statue of Limitations requires the victim to file suit within two years from the accident to recover damages associated with the injuries and damages to property. If you fail to file within the two-year period you will give up your right to bring a lawsuit, unless an exception applies. The major exception in Virginia is if a minor is involved, he or she will have two years from his or her 18th birthday to bring a lawsuit.
